Barbour traffic wreck kills one, injures another

Simeon Onnette, 46, of Lauderhill, Florida, was fatally injured when a 2004 Toyota Sienna van left the road, struck a ditch and a tree, and then overturned, according to the Alabama Law Enforcement Agency.

An investigation is underway after a single-vehicle crash early Saturday morning on U.S. Highway 82 in Barbour County, Alabama, left a Florida woman dead and another passenger injured. According to the Alabama Law Enforcement Agency (ALEA), the crash occurred at approximately 4:23 a.m. near the 221 mile marker, roughly seven miles east of Midway, when a 2004 Toyota Sienna van left the roadway, struck a ditch and a tree, and overturned.

Simeon Onnette, 46, of Lauderhill, Florida, was fatally injured in the crash and was pronounced dead at the scene. The van's driver, 35-year-old Josue Joseph of Union Springs, was operating the vehicle at the time of the crash. A third occupant, 44-year-old Jean-Charles Fausnert of Leominster, Massachusetts, was also riding in the van and sustained injuries. Emergency responders transported Fausnert to Baptist Medical Center South in Montgomery for treatment.

State troopers with ALEA's Highway Patrol Division responded to the scene and are continuing to investigate the cause of the crash. As of this report, no further details, including the events leading up to the vehicle leaving the roadway, have been released by authorities.

Location and Infrastructure

The crash occurred on U.S. Highway 82 near the 221 mile marker, a rural stretch of highway located roughly seven miles east of Midway in Barbour County, Alabama. U.S. 82 serves as a major east-west corridor through southeastern Alabama, connecting communities such as Union Springs, Midway, and Eufaula, and it carries a mix of local and long-distance traffic, including commercial and overnight travel. Rural highway segments like this one often feature limited lighting, higher posted speed limits, and roadside ditches or tree lines close to the shoulder, which can increase the severity of run-off-road crashes. The early morning hour of this crash, approximately 4:23 a.m., is also a period associated with reduced visibility and higher rates of driver fatigue on rural highways statewide.

Legal Rights and Considerations

Under Alabama law, individuals injured in motor vehicle accidents generally have two years from the date of the incident to file a personal injury lawsuit, pursuant to Ala. Code § 6-2-38. For fatal accidents, a wrongful death claim may be pursued by the personal representative of the deceased's estate, also within two years, but measured from the date of death under Ala. Code § 6-5-410. Notably, Alabama follows a pure contributory negligence standard, one of the strictest fault rules in the country, meaning a claimant found even minimally at fault may be barred from recovering damages. Alabama wrongful death law is also distinctive in that it permits only punitive damages, rather than compensatory damages, in successful claims. Insurance considerations may involve the driver's liability coverage, uninsured/underinsured motorist provisions, and, given the out-of-state residency of those involved, potential multi-state jurisdictional questions.
