I-85 Southbound Crash at Sylvan Road Injures Hapeville Police Officer and Pedestrian in Fulton County, Georgia
Hapeville officer, pedestrian injured after being hit by vehicle on I-85 Southbound in Fulton Co., officials say
According to GSP, a Hapeville Police officer was responding to a pedestrian walking on the left shoulder call when they were hit by a pickup truck.
A Hapeville police officer and a pedestrian were hospitalized after a multi-impact collision on Interstate 85 southbound at Sylvan Road (Exit 75) in Fulton County on Wednesday morning. According to the Georgia State Patrol (GSP), the Hapeville officer had been dispatched to a report of a pedestrian walking on the left shoulder of the interstate near Hartsfield-Jackson Atlanta International Airport. While the officer was inside the patrol vehicle, a pickup truck struck the back of the police vehicle, which was then pushed into the pedestrian. Troopers reported that the pedestrian suffered serious injuries, while the officer sustained minor injuries, including cuts to the face. Both the officer and the pedestrian were transported to Grady Memorial Hospital for treatment. The Georgia State Patrol and Hapeville Police responded to the scene, and southbound lanes were temporarily affected while emergency crews worked and the crash was cleared. All lanes have since reopened. The identities of the pedestrian, the officer, and the pickup truck driver have not been released, and officials have not announced whether any citations will be issued. The Georgia State Patrol is handling the investigation.
Location and Infrastructure
The Sylvan Road interchange at Exit 75 sits on a busy stretch of I-85 in south Fulton County, close to the boundaries of Hapeville, East Point, and the city of Atlanta. Its proximity to Hartsfield-Jackson Atlanta International Airport, one of the busiest airports in the world, means this corridor carries heavy volumes of commuter, commercial, rideshare, and airport-bound traffic throughout the day. Interstate traffic here moves at highway speeds across multiple lanes, leaving little margin for drivers to react to stopped vehicles or people on the shoulder. Pedestrians are generally prohibited on limited-access highways in Georgia, and a person on the left shoulder is especially exposed to fast-moving traffic in the inside lanes. Georgia's Move Over Law requires drivers to change lanes away from stopped emergency vehicles with flashing lights, or slow down below the posted speed limit if changing lanes is not possible.
Legal Rights and Considerations
Georgia is an at-fault state, meaning the driver found responsible for a crash and that driver's liability insurer are generally responsible for resulting damages. Georgia follows a modified comparative negligence rule under O.C.G.A. § 51-12-33, under which an injured party's recovery may be reduced by their percentage of fault and barred entirely if they are found 50 percent or more at fault. State law requires drivers to carry minimum liability coverage of $25,000 per person and $50,000 per accident for bodily injury, plus $25,000 for property damage. Uninsured/underinsured motorist coverage may also apply. The statute of limitations for personal injury claims is generally two years from the date of the crash, and four years for property damage claims. Recoverable damages may include medical expenses, lost wages, diminished earning capacity, property damage, and pain and suffering. Officers injured on duty may also be covered by workers' compensation.
