Teen killed in crash involving tractor-trailer in metro Atlanta

According to police officials, a truck was driving south and turned right from Cobb Parkway onto Allgood Road. That is when police say the teen allegedly split the lane and ran into the side of the trailer.

A 17-year-old boy died after an electric scooter crash involving a tractor-trailer on Cobb Parkway in Marietta, Georgia, according to police. Marietta police identified the victim as Daniel Jimenez Gutierrez. Investigators say the crash occurred as a truck was traveling south on Cobb Parkway and made a right turn onto Allgood Road. Police allege that Gutierrez, who was riding an E-scooter, split lanes and struck the side of the truck's trailer during the turn. As a result of the collision, Gutierrez was thrown from the scooter and fell beneath the tractor-trailer's tires. He was pronounced dead at the scene or shortly thereafter, according to authorities. Marietta police responded to the scene to investigate and have not yet released the name of the truck driver or indicated whether any charges are anticipated. The crash remains an active and ongoing investigation, and police have not released additional details about potential contributing factors, such as scooter speed, lighting conditions, or traffic signal status at the time of the collision. Anyone with information about the crash is likely being asked to contact Marietta police.

Location and Infrastructure

Cobb Parkway (U.S. Route 41) is one of metro Atlanta's busiest commercial corridors, running through Marietta and greater Cobb County with heavy volumes of passenger vehicles, commercial trucks, and, increasingly, micromobility users such as E-scooter and bicycle riders. The intersection of Cobb Parkway and Allgood Road sits within a mixed commercial and retail area, where large trucks frequently make turns to access nearby businesses and distribution routes. Corridors like this one often present unique hazards for scooter and pedestrian traffic due to limited dedicated lanes, multiple turning movements, and large vehicle blind spots. Right-turning trucks, in particular, present a well-documented danger to smaller vehicles and micromobility users positioned alongside or behind them, a factor commonly examined in crashes of this type.

Legal Rights and Considerations

Under Georgia law, crashes involving commercial vehicles, such as tractor-trailers, may implicate both state traffic regulations and federal motor carrier safety standards. Georgia follows a modified comparative negligence rule (O.C.G.A. § 51-12-33), meaning fault may be apportioned among involved parties, which can affect the outcome of any civil claim. Because this incident resulted in a fatality, Georgia's wrongful death statute (O.C.G.A. § 51-4-1 et seq.) may allow certain surviving family members to pursue compensation for damages such as funeral and burial expenses, loss of the decedent's future income, and the full value of the life lost. Claims of this nature are generally subject to a two-year statute of limitations under Georgia law (O.C.G.A. § 9-3-33). Insurance considerations may involve both personal auto coverage and commercial trucking liability policies.
