Crash involving Georgia State Patrol on major metro Atlanta road cleared

A Georgia Department of Transportation camera shows multiple law enforcement vehicles out on Mountain Industrial Boulevard in DeKalb County, with a vehicle hauler in place to remove at least one vehicle.

A 19-year-old passenger has died following a crash involving a Georgia State Patrol (GSP) trooper near the intersection of Mountain Industrial Boulevard and Hugh Howell Road in Tucker, Georgia. The crash occurred early Monday morning as troopers were responding to reports of illegal stunt driving involving multiple vehicles in the area near Kilman Drive and Bibb Boulevard.

According to GSP, a group of drivers had been moving between locations throughout the night engaging in stunt driving activity. When troopers arrived at the scene near Kilman Drive and Bibb Boulevard, several vehicles fled. Approximately half a mile away, a GSP Crime Suppression Unit K9 trooper traveling through the Mountain Industrial and Hugh Howell intersection collided with a GMC pickup truck that troopers had observed minutes earlier allegedly participating in the stunt driving activity.

Both vehicles caught fire following the collision. The trooper and police K9 escaped their vehicle through a window and moved to assist occupants of the pickup truck. Anthony Angeles, a passenger in the pickup, was transported to a hospital where he later died from his injuries. The driver, 20-year-old Emilio DeJesus of Conyers, was also hospitalized with injuries described as not life-threatening. GSP has not indicated whether charges are pending against DeJesus.

Location and Infrastructure

The intersection of Mountain Industrial Boulevard and Hugh Howell Road sits within Tucker, a community in DeKalb County, Georgia. Mountain Industrial Boulevard is a heavily traveled corridor connecting industrial and commercial areas, while Hugh Howell Road serves as a key east-west route through Tucker. The intersection experiences significant traffic volume throughout the day, including commercial and emergency vehicle traffic given the nearby industrial buildings referenced in GSP's account of the incident's origin near Kilman Drive and Bibb Boulevard. Intersections of this type, combining high-volume arterial roads with nearby industrial access points, are typically governed by signalized traffic control devices. The broader area's mix of industrial, commercial, and residential development, along with a nearby church noted in initial reports, reflects the varied traffic patterns common to unincorporated DeKalb County communities like Tucker.

Legal Rights and Considerations

Under Georgia law, motor vehicle accident claims are generally subject to a two-year statute of limitations for personal injury and wrongful death actions, as established under O.C.G.A. § 9-3-33, though exceptions may apply depending on case specifics. Georgia follows a modified comparative negligence standard, meaning fault may be apportioned among involved parties, which can affect recoverable damages. Because this incident involves a law enforcement vehicle, claims against a government entity may be subject to additional procedural requirements, including the Georgia Tort Claims Act's notice provisions and potentially different liability standards than claims between private parties. Families of victims in fatal accidents may be able to pursue wrongful death claims, which can address funeral expenses, loss of companionship, and other damages. Insurance considerations may involve multiple policies, including those of the drivers involved and potentially applicable government liability coverage. Those affected should consult official GSP investigation findings as they become available.
