Three people injured in Sunday crash

County police were assisted by Parkview EMS, Jeff’s Towing and DeKalb County Central Communications.

A two-vehicle rear-end collision on Interstate 69 left three people reporting injuries Sunday evening in DeKalb County, Indiana. The crash occurred at approximately 7:57 p.m. at the 322 mile marker, according to the DeKalb County Sheriff's Office.

Both vehicles were traveling southbound when a 2011 Honda Accord driven by Jacob Gersbacher, 30, of Pleasant Lake, struck the rear of a 2013 Chevrolet Silverado operated by Kayla Ramirez, 37, of Fort Wayne. Three occupants of the Silverado reported injuries at the scene: Gregory Hackley, 20, complained of facial pain; Ramirez reported neck pain; and Jose Martinez, 36, complained of chest pain. The official crash report did not indicate whether any of the injured parties were transported to area hospitals for further evaluation and treatment.

Gersbacher, who did not report any injuries, told investigators that the Ramirez vehicle "came out of nowhere." Damage to the Accord was estimated at $5,000, while the Silverado sustained approximately $3,000 in damage. Parkview EMS, Jeff's Towing, and DeKalb County Central Communications assisted sheriff's deputies at the scene.

Location and Infrastructure

Interstate 69 is a major north-south corridor passing through DeKalb County in northeastern Indiana, connecting Fort Wayne to the Michigan border and serving as a critical route for both commuter and commercial traffic. The 322 mile marker is situated near Auburn, the county seat, in an area where the highway experiences steady traffic volumes, particularly during evening hours as travelers return from weekend activities.

This stretch of I-69 features multiple lanes in each direction with typical interstate speed limits. Like many high-speed corridors, sudden changes in traffic flow can create hazardous conditions, particularly when following distances are insufficient. The evening timing of this collision, occurring shortly before 8 p.m. in late winter or early spring, may have involved reduced visibility conditions, though the crash report did not cite environmental factors as contributing causes.

Legal Rights and Considerations

Under Indiana law, drivers involved in motor vehicle accidents resulting in injury have specific rights and obligations. Indiana follows a fault-based insurance system, meaning the driver determined to be responsible for causing the collision may be liable for damages sustained by injured parties. Rear-end collisions often raise presumptions regarding following distance and driver attentiveness under Indiana Code provisions governing vehicle operation.

Injured parties may be entitled to compensation for medical expenses, lost wages, pain and suffering, and property damage. Indiana's statute of limitations generally allows two years from the date of an accident to file a personal injury lawsuit, though certain circumstances may affect this timeline. Those involved should promptly document their injuries, preserve evidence, and notify their insurance carriers. Consulting with a qualified attorney can help clarify individual rights and options under Indiana's comparative fault system.
