Pedestrian dies after being struck by car in downtown Fort Wayne

Sunday evening, officers from the Fort Wayne Police Department responded to a crash at the intersection of Clinton Street and East Baker Street involving a man in a wheelchair.

A tragic pedestrian accident claimed the life of 50-year-old Tyran Dwayne McMillian of Fort Wayne on Sunday evening, December 22, 2024, when he was struck by a vehicle while crossing South Clinton Street in his wheelchair. The fatal collision occurred around 5:45 p.m. at the intersection of South Clinton and East Baker streets in downtown Fort Wayne, near the United States Postal Service facility. According to the Fort Wayne Police Department, McMillian was crossing Clinton Street when he was struck by the vehicle during heavy rainfall conditions that significantly reduced visibility and road safety. Emergency responders arrived quickly at the scene, finding McMillian in critical condition. Despite immediate medical attention and transport to a local hospital, he was pronounced dead shortly after arrival. The driver involved in the crash remained at the scene and cooperated fully with investigating officers. The Allen County Coroner's Office ruled the manner of death as accidental, marking this tragedy as the 34th traffic fatality in Allen County for 2024.

Location and Infrastructure

The intersection of South Clinton and East Baker streets sits in the heart of downtown Fort Wayne's business district, characterized by moderate to heavy pedestrian traffic throughout the day. South Clinton Street serves as a major north-south arterial route through the city center, connecting residential neighborhoods to commercial and government facilities. The intersection lies adjacent to the USPS facility, creating regular foot traffic from postal customers and employees. This downtown area features typical urban infrastructure including traffic signals, crosswalks, and street lighting, though visibility can be significantly compromised during adverse weather conditions like the heavy rainfall present at the time of the accident. The location experiences consistent vehicle traffic during evening hours as commuters travel through the downtown corridor. Nearby landmarks include various municipal buildings, retail establishments, and service facilities that contribute to the area's pedestrian activity, making this intersection a critical point for both vehicular and pedestrian safety considerations.

Legal Rights and Considerations

Under Indiana state law, pedestrians have specific rights and responsibilities when crossing streets, particularly at controlled intersections. Indiana Code 9-21-17 establishes pedestrian right-of-way rules and driver obligations when encountering pedestrians in crosswalks. Individuals with disabilities, including wheelchair users, are afforded equal protection under both state traffic laws and the Americans with Disabilities Act. In cases involving pedestrian fatalities, surviving family members may be entitled to pursue wrongful death claims under Indiana Code 34-23-1, which allows for compensation including medical expenses, funeral costs, lost future earnings, and pain and suffering. Indiana's comparative fault system means that compensation may be adjusted based on the degree of fault assigned to each party. The statute of limitations for personal injury and wrongful death claims in Indiana is generally two years from the date of the incident. Potential sources of compensation may include the at-fault driver's liability insurance, uninsured/underinsured motorist coverage, and in some cases, municipal liability if infrastructure defects contributed to the accident.
