Man in life-threatening condition after crash with tow truck in southwest Fort Wayne

Fort Wayne Police said shortly before 7 p.m. officers were dispatched to a crash involving a white pickup truck that hit a parked tow truck.

A man remains in life-threatening condition following a serious crash on Fort Wayne's west side Thursday night, when a pickup truck collided with a parked tow truck. Fort Wayne Police were dispatched shortly before 7 p.m. to the scene near W. Creighton Avenue and Miner Street, where a white pickup truck had struck the rear of a stationary tow truck. Upon arrival, officers found the pickup's male passenger pinned inside the vehicle and immediately began providing emergency aid. Fort Wayne Fire Department personnel assisted in extricating the passenger, who was subsequently transported to a local hospital. He was initially listed in serious condition but has since been downgraded to life-threatening. The pickup's driver sustained only minor injuries and is cooperating with police. A preliminary investigation indicates the pickup was traveling west on Creighton Avenue when it left its lane of travel and struck the back of the parked tow truck. Police have stated that alcohol does not appear to be a factor at this time, though investigators continue working to determine whether speed contributed to the crash.

Location and Infrastructure

The crash occurred along W. Creighton Avenue near its intersection with Miner Street, a corridor on Fort Wayne's west side that connects to Broadway, one of the city's more heavily traveled arterial routes. This stretch of Creighton Avenue serves as a residential and mixed-use thoroughfare, and the presence of a parked tow truck at the time of the collision suggests another vehicle or roadside incident may have already been underway in the area. Following the crash, Fort Wayne Police issued a public alert around 8:10 p.m. asking motorists to avoid W. Creighton between Broadway and Miner Street until midnight; the roadway reopened earlier than expected, by approximately 11 p.m. Drivers navigating this section of Creighton Avenue should remain attentive to lane markings and be aware that stopped or parked service vehicles, including tow trucks, are a recognized hazard on Fort Wayne roadways.

Legal Rights and Considerations

Under Indiana law, drivers who leave their lane of travel and strike another vehicle may be found negligent, and fault determinations in crashes like this one typically hinge on evidence gathered during the police investigation, including findings related to speed. Indiana follows a modified comparative fault system, meaning a party found more than 51% at fault is barred from recovering damages, while a less-at-fault party's recovery may be reduced proportionally. Individuals affected by this crash should be aware that Indiana generally imposes a two-year statute of limitations on personal injury claims, though specific circumstances may affect this timeline. Insurance considerations often involve liability coverage from the at-fault driver's policy, as well as potential uninsured/underinsured motorist claims. Compensation in cases involving serious injury may include medical expenses, lost wages, and pain and suffering. Anyone involved should consult a qualified professional to understand how these general principles apply to their specific situation.
