IMPD: 2-vehicle crash kills 1 on Indy’s northeast side

Police did not say what led to the crash, but said both drivers remained on the scene.

A person died Saturday afternoon following a two-vehicle crash on the northeast side of Indianapolis. According to the Indianapolis Metropolitan Police Department (IMPD), officers responded around 4:20 p.m. on September 12 to the 6400 block of East 46th Street, near its intersection with North Kitley Avenue, after receiving reports of the collision. When officers arrived on scene, both drivers were still present. One driver was transported to a nearby hospital in critical condition and later succumbed to their injuries. Police stated that no signs of impairment were observed in either driver at the time of the crash. IMPD has not released the identities of those involved, nor additional details about the sequence of events leading to the collision. The department's fatal crash investigation team has since taken over the case, and an official cause has not yet been determined. This developing investigation underscores the seriousness of intersection-area collisions and the continued need for caution on Indianapolis roadways. Anyone with information about the crash is encouraged to contact IMPD as the investigation continues.

Location and Infrastructure

East 46th Street is a well-traveled east-west corridor on Indianapolis' northeast side, connecting residential neighborhoods to nearby commercial areas and serving as a common route for local commuters. The 6400 block, near North Kitley Avenue, sits within a mixed residential and commercial stretch where cross-traffic and turning movements are common. Like many mid-city Indianapolis intersections, this area experiences a steady flow of vehicles throughout the day, increasing the potential for conflict points between through-traffic and turning vehicles. The corridor falls under the jurisdiction of the City of Indianapolis and is patrolled by IMPD's Northeast District. Traffic control devices, signage, and posted speed limits are designed to regulate flow through this section of 46th Street, though specifics regarding traffic signals or stop-control at the Kitley Avenue intersection at the time of this crash have not been detailed by police.

Legal Rights and Considerations

Under Indiana law, drivers are required to exercise reasonable care to avoid collisions, and fault in a fatal crash is typically determined through police investigation, physical evidence, and witness accounts. Indiana follows a modified comparative fault system, meaning a party found more than 51% at fault may be barred from recovering damages. Surviving family members of a person killed in a crash may have grounds to pursue a wrongful death claim, which can address damages such as medical expenses, funeral and burial costs, lost future income, and loss of companionship. Indiana's statute of limitations for wrongful death claims is generally two years from the date of death. Insurance considerations may involve both drivers' liability coverage, as well as underinsured or uninsured motorist provisions. Those affected are encouraged to consult official records and legal counsel to understand their specific rights and options.
