New York Truck Driver Arrested On I-65 for Operating While Intoxicated

Following a roadside commercial motor vehicle inspection, Velga was placed out of service and booked into the Tippecanoe County Jail on a Class A misdemeanor charge.

A Brooklyn, New York semi-truck driver was arrested Sunday afternoon on Interstate 65 in Tippecanoe County, Indiana, after multiple 911 callers reported his commercial vehicle traveling erratically. Indiana State Police troopers responded to the reports and stopped 63-year-old Mykola Velga near the 175 mile marker on I-65. Following the traffic stop, troopers conducted a roadside commercial motor vehicle inspection and determined that Velga was operating the semi-truck while intoxicated, with a blood alcohol concentration (BAC) of .15 or more—nearly twice the legal limit for commercial drivers. As a result of the inspection, Velga was placed out of service, meaning he was prohibited from continuing to operate the vehicle. He was subsequently arrested and booked into the Tippecanoe County Jail on a Class A misdemeanor charge for operating while intoxicated. No collision was reported in connection with the stop. Indiana State Police used the incident to remind the public that impaired operation of a commercial motor vehicle poses a severe and potentially deadly risk to other motorists given the size and weight of semi-trucks.

Location and Infrastructure

The traffic stop occurred near the 175 mile marker on Interstate 65 in Tippecanoe County, a stretch of interstate that runs through north-central Indiana and serves as a major freight corridor connecting Indianapolis to Chicago and other Midwest markets. This section of I-65 carries a heavy volume of commercial truck traffic daily, making driver impairment an especially serious concern given the potential for catastrophic outcomes in the event of a crash. Tippecanoe County, home to the city of Lafayette and West Lafayette, sits along this well-traveled corridor. Indiana State Police regularly patrol this segment of interstate and rely on public reports, such as the 911 calls that led to this stop, to identify and remove dangerous drivers from the roadway before a crash can occur.

Legal Rights and Considerations

Under Indiana law, commercial drivers are held to a stricter BAC standard than non-commercial motorists, and operating a commercial motor vehicle while intoxicated can result in criminal charges, license disqualification, and civil liability if a crash occurs. Had this impaired operation resulted in a collision, injured parties may have been entitled to pursue compensation for medical expenses, lost wages, property damage, and pain and suffering through a personal injury or wrongful death claim. Commercial trucking companies may also bear liability under theories of negligent hiring or supervision. Indiana's statute of limitations generally allows two years from the date of an incident to file a civil suit. Insurance considerations in commercial trucking cases often involve multiple layers of coverage, including the driver's policy and the motor carrier's commercial liability insurance. Anyone affected by a similar incident should consult a qualified professional to understand their specific rights.
