Mesquite I-635 construction worker killed after being struck by off-duty officer

Torres is not satisfied with the DA’s opinion and thinks the off-duty officer should be charged.

A 22-year-old construction worker and father, Edwin Valdez, was killed after being struck by a vehicle driven by an off-duty police officer in a highway construction zone in Mesquite, Texas. The fatal crash occurred around 11:30 p.m. on June 23 on Interstate 635 near Highway 80. According to Mesquite police, a construction crew was in the process of relocating a crane from the east side of the interstate to the west side when the accident took place. An off-duty officer from the Southwestern Christian College Police Department, who was working security or traffic control at the construction site, was driving southbound on I-635 to prepare for the next scheduled road closure when the vehicle struck Valdez, who was guiding the crane across the freeway. Emergency responders transported Valdez to a local hospital, where he later died from his injuries. The crash remains under investigation by Mesquite police. Questions remain regarding whether speed or visibility played a role in the collision. After consulting with the Dallas County District Attorney's Office, authorities have indicated they do not currently expect to file criminal charges. The name of the officer involved has not been released.

Location and Infrastructure

The crash occurred on Interstate 635 (LBJ Freeway) near its interchange with Highway 80, a heavily trafficked corridor in Mesquite, a city in Dallas County, Texas. This stretch of I-635 has been the site of ongoing highway construction, requiring periodic lane closures and equipment relocation, including large machinery such as cranes. Nighttime construction work in active traffic lanes presents elevated risks, particularly during equipment transitions between roadway sides. Standard safety measures in these zones typically include warning signage, reduced speed limits, temporary barriers, and designated worker safety zones. Given the freeway's high traffic volume and the complexity of coordinating overnight lane shifts and crane movements, this interchange has long been recognized as a high-risk area for both construction personnel and passing motorists, particularly during multi-phase road closure transitions like the one underway at the time of this incident.

Legal Rights and Considerations

Under Texas law, individuals injured or killed in construction zone accidents may have grounds for civil claims separate from any criminal investigation outcome. Texas follows a modified comparative negligence standard, meaning liability may be apportioned among multiple parties, including the driver, the officer's employer, the construction company, or entities responsible for work zone safety protocols. Workers' compensation claims may also apply depending on the victim's employment status at the time of the incident. Texas generally imposes a two-year statute of limitations for personal injury and wrongful death claims, though exceptions may apply. Families of victims may be entitled to pursue damages for funeral and burial expenses, lost future earnings, loss of companionship, and pain and suffering. Because law enforcement involvement can introduce additional complexities, including potential government liability considerations, affected individuals are encouraged to consult a licensed Texas attorney to evaluate their specific legal options.
