Police said a review of video evidence found that speed was a significant factor in the crash, and that pedestrian warning lights were active and functioning when Rosen was crossing the street in the crosswalk.

A tragic pedestrian accident claimed the life of a 17-year-old high school student on the morning of February 5, 2025, in Madison, Wisconsin. According to the Madison Police Department, the incident occurred around 7:55 a.m. near the intersection of South Park Street and North Avenue as the teenager was crossing the street on their way to school. The student was struck by a vehicle and sustained fatal injuries. Emergency responders arrived at the scene promptly, but despite their efforts, authorities announced around 10 a.m. that the teenager had died as a result of injuries sustained in the crash. The roadway was closed for investigation and evidence collection, reopening to traffic at approximately 10:25 a.m. The Madison Police Department has not yet released the identity of the victim or the driver involved. The incident remains under active investigation, with authorities promising to release additional information as it becomes available. This devastating loss has impacted the Madison community, particularly students and families in the area.

Location and Infrastructure

The intersection of South Park Street and North Avenue is located in a busy area of Madison's south side, serving as a major commuting corridor for local residents, including students traveling to nearby schools. South Park Street is a significant arterial road that carries heavy traffic volumes during morning and evening rush hours, connecting residential neighborhoods with commercial districts and educational institutions. The area features sidewalks and marked crosswalks, though visibility and traffic flow can be challenging during peak travel times. North Avenue intersects South Park Street in a neighborhood characterized by a mix of residential properties, businesses, and proximity to educational facilities. The intersection's location along a well-traveled student route makes pedestrian safety a critical concern, particularly during school arrival and dismissal times when foot traffic increases significantly.

Legal Rights and Considerations

Under Wisconsin law, pedestrians in marked crosswalks have the right-of-way, and drivers are required to yield to individuals crossing the street. Wisconsin Statute 346.24 establishes driver duties toward pedestrians, while Wisconsin Statute 346.57 addresses pedestrian right-of-way in crosswalks. Families affected by fatal pedestrian accidents may be entitled to pursue wrongful death claims under Wisconsin Statute 895.04, which allows designated family members to seek compensation for funeral expenses, lost financial support, loss of companionship, and medical expenses incurred prior to death. Wisconsin imposes a three-year statute of limitations for wrongful death actions from the date of death, making timely legal consultation important. Insurance considerations may include the at-fault driver's liability coverage, uninsured/underinsured motorist coverage, and potential medical payments coverage. The investigation's findings regarding driver negligence, pedestrian positioning, road conditions, and traffic control device compliance will be critical factors in determining liability and potential compensation.
